The United States Supreme Court has decided not to move forward with a wrongful death lawsuit directed at former New York Governor Andrew Cuomo. This decision ends a legal challenge regarding policies implemented during the early stages of the COVID-19 pandemic.

The lawsuit was led by Daniel Arbeeny, whose father passed away in 2020 while residing in a nursing home facility. Arbeeny and other families alleged that the Cuomo administration's directives contributed to the high number of fatalities.

By denying the petition for certiorari, the high court let stand previous rulings from lower judicial bodies. These lower courts found that the former governor was protected by the principle of qualified immunity.

Qualified immunity shields government officials from liability unless they violate clearly established statutory or constitutional rights. Judges determined that the actions taken during the public health crisis did not meet this threshold.

The dispute centers on a March 2020 guidance issued by the New York State Department of Health. This directive required nursing homes to admit residents who had tested positive for the virus.

State officials argued the policy was necessary to prevent the hospital system from becoming overwhelmed. They maintained the goal was to ensure emergency beds remained available for the most critically ill patients.

Critics contend that introducing infected individuals into environments with vulnerable seniors led to thousands of preventable deaths. Estimates suggest approximately 15,000 elderly residents in New York nursing homes died from the virus.

A spokesperson for the former governor stated that every investigation and court review has reached the same conclusion regarding the lack of wrongdoing. They emphasized that the facts have been settled.

Families involved in the suit expressed deep disappointment with the judicial system. They continue to maintain that the administration manipulated data and politicized the suffering of their loved ones.
