Bond Reduced for Venezuelan National in Case Involving Fatal Shooting of Unborn Child

A North Carolina judge has significantly reduced the bond for a Venezuelan national facing charges related to a domestic shooting that resulted in the death of an unborn child. Judge Karen McCallum lowered the bail for Luis Marcano-Marcano from $1 million to $25,000 on Tuesday.

Marcano-Marcano was arrested in Mint Hill following reports of gunfire at an apartment complex. Investigators allege the suspect was firing a weapon while under the influence of alcohol and narcotics when a struggle occurred with his pregnant wife.

Court documents indicate the woman tried to disarm Marcano-Marcano to prevent further violence. During the struggle, the gun discharged, striking her in the abdomen and killing her seven-month-old unborn baby.

The initial $1 million bond was set by a magistrate citing law enforcement reports of the suspect’s background. Officials alleged Marcano-Marcano has outstanding warrants in Venezuela and potential ties to the Tren de Aragua gang.

Judge McCallum’s decision to adjust the bond has sparked debate regarding judicial discretion. The reduction occurred despite the gravity of the incident and the suspect's status as a foreign national.

Marcano-Marcano currently faces a misdemeanor charge for discharging a firearm within city limits. Prosecutors stated that upgraded charges remain possible as the investigation into the fetal death continues.

Immigration and Customs Enforcement has placed a detainer on the suspect. This follows a broader mandate from the administration of President Donald Trump to prioritize enforcement against members of transnational criminal organizations.

Tren de Aragua has become a focal point for federal authorities seeking to dismantle foreign gang networks. The White House has frequently called for more stringent bail requirements for defendants linked to such groups.

Marcano-Marcano remains in custody at this time. The Mecklenburg County District Attorney’s office has not clarified if they intend to challenge the bond reduction in a higher court.

The Mint Hill Police Department is continuing its probe into the shooting. The case highlights ongoing tensions between local judicial rulings and federal immigration enforcement priorities.
