Miami-Dade Judge Grants Bond to Juvenile Charged as Adult in Sexual Battery Case

Miami-Dade Circuit Court Judge Richard Hersch has issued a ruling regarding the pre-trial detention of three minors charged as adults in a June sexual battery case. One defendant was granted bond while the others remain in custody.

Jusiah Jones, 12, was granted release on bond and placed under strict house arrest following multi-day Arthur hearings. These proceedings determine if defendants charged with serious offenses may be released before trial.

The other two defendants, 13-year-old Nelson Nunez and 15-year-old Xavier Tyson, were denied bond. They will remain in custody pending trial.

All three are facing adult charges of sexual battery, kidnapping, and false imprisonment. The charges stem from an incident reported at the Green Haven Project community garden in Overtown.

Police reports state a 12-year-old girl was allegedly held and assaulted for approximately 30 minutes. Prosecutors argued for continued detention citing the severity of the allegations and potential safety risks.

Recent social media activity has brought renewed attention to the case. A post from a high-traffic account on X highlighted the decision to release the youngest defendant.

The viral post has garnered tens of thousands of views and features court footage of the proceedings. The video shows one of the defendants reacting in the courtroom while a family member provides testimony regarding his character.

Public reaction includes intense debate over juvenile justice and the appropriateness of adult charges for young minors. Critics of the ruling express concern over public safety, while others emphasize the constitutional requirements for pre-trial release.

The defendants have pleaded not guilty. The legal process continues to navigate the complexities of prosecuting juveniles in the adult court system for first-degree felony offenses.

No trial date is currently set. The Miami-Dade State Attorney’s Office is proceeding with the prosecution of all three individuals for the June incident.
