Rep. Anna Paulina Luna Raises Legal Concerns Over Alleged Eric Swalwell Video

Representative Anna Paulina Luna (R-FL) has raised new allegations regarding a controversial video involving former Representative Eric Swalwell, suggesting the footage may have been recorded by a minor. The claims, made during a Fox News segment, add a potential criminal dimension to the scandal that led to Swalwell’s resignation from Congress.

During an interview with host Jesse Watters, Luna stated that forensic analysis is being used to verify the origin of the recording. The video reportedly depicts Swalwell in a hotel room with a sex worker. Luna alleged that the person behind the camera might have been an underage female, which could lead to severe prosecution.

"Potentially, the individual that recorded that video in that hotel room was a female and she was under age," Luna said. She suggested that the former California congressman faces "serious criminal problems" and speculated that the situation could result in jail time following forensic confirmation of the footage.

These developments come a day after Swalwell announced his resignation on April 13, 2026. His departure followed misconduct allegations from four women, including a former staffer who accused him of sexual assault while she was intoxicated. Other claims involve unsolicited explicit messages and photographs sent to several individuals.

Swalwell has denied any criminal wrongdoing, though he admitted to "mistakes in judgment" in a statement to his constituents. He has characterized the most serious allegations as "false" and vowed to fight them legally. He previously noted that a rush to judgment without due process was a disservice to the voters.

The political fallout has intensified in Washington, where President Donald Trump continues his term. Republican lawmakers have called for a full investigation into the hotel room recording, and forensic teams are reportedly working to confirm the authenticity of the digital evidence. Luna indicated that additional details are expected to be released soon.

Legal experts note that if a minor was involved in the recording, federal authorities may pursue charges. The Manhattan District Attorney’s office is already investigating separate claims of misconduct involving an incident from 2024. The former representative has not yet been charged with a crime in either matter.

As of Tuesday, April 14, 2026, no formal criminal charges have been filed regarding the recording claims. Law enforcement agencies continue to monitor the evidence surfacing in the wake of Swalwell’s exit from office. The situation remains a primary focus for the House Ethics Committee and judicial observers.
